Judicial Review (chart)

Judicial review is the equivalent of Public interest litigation (PIL) concept in India which was highlighted in my earlier post- What is the MCT.

Judicial Review is a mechanism for ensuring that ministers and public bodies (government body/s) keep within the proper limit of the powers which they have been granted. Judicial Review is concerned with the legality of the decision made, not with the merits of the particular decision (i.e., how the decision was reached and not the decision itself).

The things you should be able to identify under this topic are-

  1. Whether the issue is a public law issue and/or a decision by a public body
  2. Identify whether the claimant falls within the meaning of ‘sufficient interest’ test or under HRA a ‘victim’ test
  3. Identify the grounds under which you can file a JR application

This topic is very simple and straight forward and one of those where you only need to read it once to understand. I have attached a chart which should make remembering the points easy for you. So feel free to download and share the attachment!
